Deposit Agreement

1. The Buyer’s wait list deposit is only effective after Tubb’s Puppies wait list Agreement has been completed, signed, and dated by the Buyer and Tubb’s Puppies receives the full amount of the wait list deposit, $100 plus applicable credit card fees.
2. The Buyer’s wait list deposit guarantees at least one opportunity in the next 12 months to select a puppy that matches their desired breed and sex specifications. If the Buyer does not select the first puppy available that meets their breed and sex specifications, the following options are available to the Buyer:
   1. The Buyer can wait for the next litter available. The Buyer will move to the bottom of the wait list.
   2. The Buyer can choose from any puppies or adult dogs currently available. The Buyer will move to the bottom of the wait list.
3. All deposits are non-refundable.
4. If the Buyer does not choose a puppy within 12 months from their $100 deposit, their deposit is voided and forfeited. No refund will be given by Tubb’s Puppies.
5. If the Buyer cancels their puppy order, the deposit is voided and forfeited. No refund will be given by Tubb’s Puppies.
6. After Tubb’s Puppies opens selection on a litter to the Buyer, the Buyer must choose their pick in a timely manner so as not to disrupt other buyers with deposits. If the Buyer delays by more than 24 hours after Tubb’s Puppies opens selection to them, Tubb’s Puppies will allow other buyers to pick ahead of the Buyer. Once a puppy has been selected, the Buyer cannot switch to other puppies available, as this disrupts the selection process of other buyers.
7. After a puppy has been selected the Buyer must do the following:
   1. Sign a final purchase agreement provided by Tubb’s Puppies to confirm the selection of their puppy, Available Here. Signing the Tubb’s Puppies Deposit Agreement indicates that the Buyer agrees to the terms of the Pet Bill of Sale and Contract.
   2. Pay $400 plus applicable credit card fees as a deposit on their puppy. This plus the $100 wait list deposit makes for the total $500 deposit Tubb’s Puppies requires for holding a puppy.
8. The remaining balance on the puppy is to be paid at least seven business days before the puppy’s “available for pickup” date. The balance can be paid in person on pickup if the Buyer is paying in cash. If the balance is not paid in full seven business days before the “available for pickup” date or paid in cash on pickup, the deposit and purchase is voided and forfeited. No refund will be given by Tubb’s Puppies.
9. The “available for pickup” date is an estimate, and Tubb’s Puppies reserves the right to change the “available for pickup” date to ensure the puppy is ready to go home.
10. The Buyer agrees to take possession of the puppy no later than one week after the “available for pickup” date. The Buyer will take possession of the puppy at Tubb’s Puppies location in person or through a transportation agent employed by the Buyer. If the Buyer does not take possession of the puppy within the allotted time as outlined, the Buyer agrees to pay Tubb’s Puppies standard kennel fees and expenses, and Tubb’s Puppies reserves the right to cancel the sale and have the Buyer’s deposit voided and forfeited. No refund will be given by Tubb’s Puppies.
11. Tubb’s Puppies does not guarantee size, temperament, or color of any of its puppies. Tubb’s Puppies may give estimates of the puppy’s adult traits based on their experience, but these are not a guarantee.
12. Tubb’s Puppies reserves the right to cancel the sale and refund the total deposit amount at any point before the puppy enters the possession of the Buyer.
